These suppliers vigorously promote that CBD must be derived from the stalks of industrial hemp. They base this conclusion on the 1970 Controlled Substances Act.


“The term “marihuana” means all parts of the plant Cannabis sativa L. [sic], whether growing or not; the seeds thereof; the resin extracted from any part of such plant; and every compound, manufacture, salt, derivative, mixture, or preparation of such plant, its seeds or resin. Such term does not include the mature stalks of such plant, fiber produced from such stalks, oil or cake made from the seeds of such plant, any other compound, manufacture, salt, derivative, mixture, or preparation of such mature stalks (except the resin extracted therefrom), fiber, oil or cake, or the sterilized seed of such plant which is incapable of germination.”

CBD from stalk is a very poor source of CBD. The stalk provides 25ppm CBD compared to 150,000 ppm from the flowers and leaves from CBD rich cannabis strains.

Legal Definition of CBD

The American definition of industrial hemp was created for the first time by federal law in 2014. The cannabis plant now has 2 distinct definitions in federal law.

According to Section 7606 of the 2014 Farm Bill, Cannabis was hemp, not marijuana, as long as no part of the plant (including the leaves and flowers) exceeded a THC concentration of “more than 0.3 percent on a dry weight basis.


“Section 7606 of the Farm Bill defines industrial hemp as "the plant Cannabis sativa L. and any part of such plant, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis."


After some confusion about the DEA interpretation of cannabis “extracts” DEA Administrator, Chuck Rosenberg offered a clear and definitive definition while testifying before a Congressional committee on April 8, 2017


Representative Bob Goodlatte, R -VA, the Judiciary Committee Chair asked the head of the DEA about the legality of hemp, specifically cannabidiol (CBD). He was concerned about harassment regarding hemp.


As you can see in the following C-SPAN video, DEA Chief Rosenberg firmly and definitively states there is no problem concerning hemp when hemp meets the standards of Section 7606 of the 2014 Farm Bill.
